“Steel Industry” had priced each of its controlled transactions on a separate basis. The tax authorities disagreed with this approach and instead priced all controlled transactions on an aggregated basis using the TNMM with ROA as the profit level indicator. On this basis, an assessment of additional taxable income was issued.

An appeal was lodged by the steel industry, which eventually went to the Supreme Administrative Court.

Judgment

The Supreme Administrative Court ruled in favour of “Steel Industry”.

According to the Court, the tax authorities had failed to provide sufficient evidence that the approach adopted by “Steel Industry” did not lead to an arm’s length result.
